Describe: Adversary System.
a. allows the two sides in a lawsuit to obtain, before trial, documentary and other evidence from the opponent.
(Discovery is the critical, pre-trial opportunity for both parties to learn the strengths and weaknesses of the opponent's case.)
b. a way to bring out the truth from the two contesting sides, allowing them present the strongest case possible to a neutral fact finder.
(Each side presents its witnesses and then the opponent has a chance to cross-examine. The adversary system presumes that by putting a witness on the stand and letting both lawyers "go at" her, the truth will emerge.)
c. allows both sides to submit written arguments on the case and then to give 15 minutes to give an oral argument in from of a panel of three or more judges.
d. a litigation that affects more than one plaintiff, that can be combined into a single trail (can give the plaintiff much greater leverage, since the defendant's potential liability is vastly increased)
