The  prior restraint defines  as "government action that prohibits speech or other expression before the speech occurs."

Another example of a "pre-emption claim" occurred in 1971, when the United States government tried to prevent the New York Times and the Washington Post from publishing classified documents known as the "Pentagon Papers" regarding the government's conduct in the Vietnam War.
