This is a question that seems odd for this site but, i'm doing a school paper on student rights and such.
A student i know was going off campus for lunch ( with the right to do so from the school ) and he left school grounds and went to a local restaurant and only then did he smoke his cigarette away from school grounds. He is legally able to buy and smoke cigarettes (age 18 ) . He was suspended for the week for doing so, and i cant find anything in our schools policies and or handbook that suggest that smoking during off campus lunch is prohibited. Is this violating his First Amendment Rights?

He should be able to smoke because 1. he was off campus and 2. he's 18 which is a legal adult 3. there's no policy stating he can't do such
